PLEASE READ. By signing below, you acknowledge that you have read and agree to all of the terms listed below.

Usage Rights / Ownership

By booking a property shoot with Rice Nation Media LLC ("we," "us"), the client ("Client") agrees that all photos, videos, and related media ("Content") remain our sole property and copyright. The Client is granted a limited, non-transferable license to use the Content solely for the marketing and sale of the specific property captured. Redistribution, resale, or repurposing for other properties, services, or third parties is prohibited without our written consent. Any third party, including a successor agent or broker, buyer, owner, builder, stager, or designer, must obtain a separate written license from us and pay any applicable fee before using the Content. After closing, the Client may continue to use the Content for "Just Sold" announcements and the Client's own portfolio. The Client may not alter the Content in ways that misrepresent the original work. This includes, but is not limited to, the Client's or any third party's use of artificial intelligence to virtually alter, stage, or change the Content in any way. Edits ordered from us, such as virtual staging or AI twilights, are part of our service and are not restricted by this clause. We reserve the right to use Content for portfolio, promotional, or social media purposes unless otherwise requested in writing.

Compliance With Advertising Standards & Local Laws

We provide professional image and video editing services at the discretion of the Client. The Client acknowledges that various jurisdictions, Multiple Listing Services (MLS), and regulatory bodies have specific and evolving rules regarding the disclosure of "digitally altered" images and videos. It is the sole responsibility of the Client to determine if provided images and videos require disclosure under local laws or guidelines. By accepting and using this media, the Client assumes all liability for the proper disclosure and representation of the property, and agrees to hold Rice Nation Media LLC, its owner, and its employees harmless from any fines, legal actions, or disciplinary measures resulting from the publication of these images or videos.

General Liability

We are not liable for any injuries, damages, or losses incurred during the shoot. The Client is responsible for ensuring the property is clean, accessible, and ready to shoot at the scheduled time. To the fullest extent permitted by law, our total liability for any claim relating to a shoot or the Content will not exceed the fees paid for that shoot, and we are not liable for any indirect, incidental, or consequential damages.

Shoot Day Terms

Properties are shot "as-is" and we are not expected to clean, de-clutter, or move items. It is strongly requested, but not required, that the homeowner be away for the duration of the on-site visit to ensure a seamless workflow for the Client and our team. If we are responsible for opening, unlocking, preparing, and/or closing the property, additional fees may apply. If the Client is not present at the time of the shoot, or during the full duration of the on-site visit, unless specifically noted in the pre-shoot form, our creative choices are deemed "final." This includes, but is not limited to, the staging of furniture, lighting, angles, compositions, music choices, and the amount of images and/or videos delivered. Aerial photography is included only with Signature Photography, and aerial video only with Signature Film, where airspace, weather, and safety allow. If aerial cannot be flown, we may reschedule the aerial portion or complete the shoot without it, and we will include more photos of the listing whenever possible; because aerial is included at no additional cost, the price does not change. Drone Photography ordered as an add-on that cannot be flown will be rescheduled or removed from the invoice.

Cancellation & Rescheduling

Unexplained cancellations made within 48 hours of the scheduled shoot are billed at 50% of the total shoot cost, and those made within 24 hours are billed in full. Rescheduling or cancellation due to weather, emergencies, or other circumstances outside the Client's control is handled at our discretion. The Client may explain any cancellation in writing to [email protected]; we review each case individually and issue refunds where we deem appropriate.

Revisions

Revisions are made at our discretion, and extensive revision requests may result in additional fees. The first round of revisions is typically free, and additional revisions are billed at $100/hour. If revisions are not provided within 48 hours of delivery, additional fees will apply. Free revision rounds are only available within 48 hours of delivery due to capacity. We appreciate your understanding and will make our best effort to cooperate with any changes you have to our work.

Payment

Payment is due at the time of booking, or at close of escrow through our payment partner Titus if you choose that option and are approved. If you choose to receive an invoice, it is payable by card or bank, and your appointment is not confirmed until payment is received. If pay at close is not approved, or you change your mind, we will issue an invoice payable by card or bank instead; before paying it, please make sure your Titus application is withdrawn so you are not charged twice. Payment reserves your shoot date. We do our best to accommodate and hold requested dates, but without payment we cannot guarantee them, and dates are released on a first come, first served basis. Downloads are released when payment clears; if the invoice is still open when the gallery is ready, the gallery stays locked until it is paid. Add-ons requested after payment are billed separately. Property websites include one year of hosting and the custom domain. The cancellation terms above still apply.
